Case:

Marcelle Fitzgerald is a full-time registered nurse at a juvenile rehabilitation facility in Greensboro, NC. At 10 pm on December 20th, 2019, she entered the room of Abigail Connor, 14 years old and Rebecca Juarez, 15 years old. Ms. Connor was lying on her bed, partially clothed, and a man dressed in black climbed out the window and disappeared in the trees behind the nursing home. Ms. Connor has severe developmental disabilities and although she was upset, she could not describe what had happened to her or who the man was. The police and an ambulance were called and it was later determined that Ms. Connor had not been sexually assaulted. Ms. Fitzgerald could only say that it looked like a man, and that she did not see his face at all, only his back. Questioning of the roommate Rebecca Juarez, revealed that Ms. Juarez had been asleep that night, but woke to see a shadow of a man get up from her roommate’s bed moments before the door opened and Ms. Fitzgerald entered and the man crawled through the window. Ms. Juarez described the man as “tall, athletic, built like a football player.” Police searched the woods with dogs but did not find anyone.

One month later, the police apprehended a man who was caught in the act of attempting to break and enter a different rehabilitation facility in Kernersville. He was Kevin MacDonald and had been convicted three times before for assault and robbery. He was awaiting trial for attempted robbery at Target (which was much publicized in the local papers) when his photograph was placed into a lineup that was shown to Ms. Juarez. Six photographs were compiled based on Ms. Juarez’s description of the assailant. They were presented to her via a computer simultaneously. She was warned that the culprit may or may not be in the lineup. Mr. MacDonald’s photograph was in position three. When she saw the photograph, Ms. Juarez immediately decided that this was her assailant and pressed the appropriate button on the computer keyboard. She was next asked to indicate her confidence in the decision and she chose 7 on a scale of 1-10 (1 = not at all confident, 10 = extremely confident). When she was done with the computer task, the investigating officer returned to the room and told her that she did a good job.

Kevin MacDonald was questioned about the crime against Ms. Connor. At first, he denied the charge, but after eight hours of questioning he eventually confessed to the crime. The next day, MacDonald recanted the confession. At trial, Ms. Juarez confidently identified Kevin MacDonald in the courtroom as the assailant. The judge instructed the jury to weigh the evidence carefully and to vote guilty if they believed that Mr. MacDonald was guilty beyond a reasonable doubt. The six-person jury deliberated for two hours and rendered a guilty verdict.
