Activity 3 – Creating a Lease

Your have decided to run a day spa, and you are looking to lease space from which you can operate the business. You have found a potential space in a strip mall, with neighboring businesses on both sides and above. On the exterior, a sidewalk that links all of the businesses in the strip, and a large parking lot fronts the space. The space is not ideal, and in some ways, you feel you are settling, but you need to get up and running, and this is the best you can find at the time.

In the spa, you intend to have a steam room, a whirlpool (to be installed), a massage room, and a meditation room. You also plan to install a series of expensive lighting fixtures that create a diffuse and peaceful ambience. The floor is currently hard vinyl tiles, and you would like to install ceramic tile. You also envision painting the walls warm and relaxing colors.

Use the information you obtained from the readings about landlord-tenant law, and compile a list of clauses that you would like to see included in the lease. Set forth the rationale for drafting the provision in the fashion you chose. Remember, it is best to include provisions in writing even if the law provides them as a default. In addition, compile a list of potential sticking points, that is, resistance you expect to receive from the property owner during lease negotiations. On which provisions will you stand firm, and on which will you concede? Thus, when you are done, you should have (1) a series of technically drafted leases provisions, (2) an explanation of why you included the provisions and the impact they shall have, and (3) a description of your negotiating strategy.

The paper should be 750-1250 words, in APA format, and include at least two references beyond the text, preferably peer-reviewed.
