The Church needed to make some modifications to better and adapt the place, and this promise of donation was for them a good way to get it, believing in the promise; the church contracted the architect and the contractor to do the work and made an initial payment, during the days the Bishop called the CEO of ABCD Company again and assured himself that he would receive the donation in a few days, as a result of that conversation the Bishop went ahead to pay for the work to architect and contractors.
After a few days later the Bishop called the CEO of the ABCD Company to specify when he would receive the donation, but due to a bad economic situation the company was unable to make the donation at that moment.
The Bishop of Narnia Church, trust in the promise made by the CEO of the ABCD Company regarding the donation of money, and if he goes to the court he may have an opportunity to win, because under the law promises of donation to charities can be enforceable under the doctrine of promissory estoppel as a matter of public policy, and there need be no showing of consideration or detrimental reliance.
However in some cases, court have different view that donation should not be compulsory binding on pledge. But in most cases, court favored the charities, because they take some action on the promise of donation by a donor. This action cannot be reverse even if the donor in actual not in position to fulfilled their commitments.
The court can take some similar cases in order to use them as a reference and could be used as a base for the court to dictate a favorable verdict for the Company. They could try to find cases where promissory estoppel was not enforced by the court. ABCD Company made the promise to donate the money to Narnia’s Church, but for some reasons the things were not going well for them, for that the promise can’t be fulfilled at that moment.
As a conclusion the Court could be a verdict in favor of the church, but if the ABCD Company hired a good Lawyer they could try not to have to pay so much money since the economic situation of the company at that time was not the best, which is why they failed with their promise.
