Roles of original jurisdiction
Original jurisdiction grants a court the power to hear and decide a case for the first time it appears in a courtroom before it is reviewed by the appellate if either party of the case files an appeal for a high court’s further hearing (Texas Government, 2020, p. 4). The courts tasked to hear first time cases must have the mandate of hearing cases extending to subject matter jurisdiction, jurisdiction over people as well as jurisdiction over the property. This jurisdiction is not only original but also exclusive (Cornell Law School, 2020, p. 3). Meaning that if the disgruntled parties fail to settle the matter at the courts of original jurisdiction, then no other court but the Supreme Court has the authority to take the jurisdiction.
Roles of appellate jurisdiction
Appellate jurisdiction is tasked with hearing cases moved up by the lower courts when either party of a court case is not satisfied with rulings of the lower courts. Such parties must file an appeal requesting for their case to be moved to the high courts for a further hearing (Texas Government, 2020, p. 4). The high court is mandated to verify the law’s application or the violation of one’s rights about the case. It reviews the rationale for the ruling provided by the lower court, considering there is no new evidence in deciding whether to remand, affirm, or reverse the verdict. Therefore, both the original and appellate jurisdiction plays a crucial role throughout the hearing of any court case.
