Do You Think Congress and The President Have Done Enough to Protect Bureaucratic Whistle-Blowers?

Congress and the president have not done enough to protect bureaucratic whistleblowers. The executive arm of government has in the past criticized, condemned, and even prosecuted whistleblowers who have revealed government wrongdoing. Retaliation against whistleblowers has been normalized in the executive arm under the president. For instance, the prosecution of Edward Snowden who revealed massive spying by the NSA on American citizens, the victimization and later firing of Alexander Vindman who testified against President Trump in his controversial call with the Ukrainian President (VonGonten, 2019). Congress has not enacted laws to protect whistleblowers from prosecution and retaliation. On the contrary, they have joined the president in victimizing whistleblowers. However, not every congressman has sided with the adversaries in victimizing bureaucratic whistleblowers. Many progressive representatives have called for the protection of whistleblowers who have revealed massive wastage and misuse of power within the government.

While Congress has codified protections for whistleblowers systemic failures often make those protections meaningless. Whistleblowers face retaliation because of failures in the protections set by congress like Merit Systems Protection Board (MSPB). The lack of quorum in MSPB that is supposed to protect whistleblowers means that whistleblowers cannot enforce their protections and are therefore in bureaucratic limbo. Congress has not passed laws that can allow whistleblowers to take their cases directly to the court to protect them against retaliation. Congress has failed to address whistleblower protection laws in areas such as the Intelligence Community (Chaloat et al., 2019). The presence of inspectors, in general, gives bureaucratic whistleblowers room to report cases. However, the inspectors lack the power to enforce system changes that correct wrongs and protect whistleblowers. Such flaws in whistleblower protection laws have exposed bureaucratic whistleblowers and congress is responsible.
