The management of criminal justice operations is influenced by sections, divisions and bureaus that determine the procedural changes in the criminal justice process (Cole, Smith and DeJong, 2021). Therefore, this paper will focus on one of the sections of the criminal justice. The paper’s main aim is to analyze how the Office of Legal Affairs influences the criminal justice agency operations.

Background

The Office of legal affairs offers a unified central legal service for the principal and secretariat and other organs of the United Nations and contributes to the codification and progressive development of international public law. The Office of legal affairs was developed in 1964. At first, it was structured as a department but later was recognized as an office to provide more legal advice and act on legal matters on behalf of government agencies. Additionally, the Office of legal affairs helps understand and respect the laws and norms of the international laws among the public. The Office consists of numerous lawyers that deal with varying sectors such as international humanitarian laws, international criminal justice, peacekeeping operations and laws for seas. Considerably, all the decision-makers within the Office of legal affairs sectors are charged with the duty of understanding the implications and operations of the legal choices they make and arriving at appropriate legal decisions.

Methodology Section

The study focused on the Texas Department of Criminal Justice. The Texas Department of Criminal Justice system is the largest state agency in Texas. The Texas Department of Criminal Justice focuses on the state criminal justice for adult offenders, such as managing state jails, state prisons, supervision of offenders and supervising private correctional facilities. The study relied on both primary and secondary research methods to collect data. The research on the influences of the Office of legal affairs on criminal justice agency operations was done through a systematic review, interviews and the use of questionnaires. The questionnaires and interviews were conducted within the Office of legal affairs to understand its operations and accomplishments.

Collecting primary data allows for gathering information for the specific purpose of the study. The questions asked in the questionnaires and the interview questions were tailored to offer information that will help achieve the research study. The questions were based on the Office of legal affairs operations and how the practices and operations generally impact the criminal justice agency. The questions were issued randomly to the employees. The questions were easy to navigate and short, thus requiring less information from the employees. Interviews were conducted with several personnel in the Office. The interviews lasted for about thirty minutes. The interviews offered useful information regarding the specific practices of the Office of legal affairs.

To achieve the established goals of the study, it’s vital to conduct interviews with the personnel working in the Office of legal officers about their responsibilities and how they influence the criminal justice agency operations. Therefore, primary data in the form of interviews will be obtained from the personnel. The semi-structured face to face interviews will be carried out concerning different levels of interviewees’ ages and education. The semi-structured interview allowed the collection of open-ended data and exploration of participants’ feelings, thoughts and beliefs regarding a particular topic (Pandey and Pandey, 2021). Creating a standardized list of questions and assessment techniques made it possible to compare the candidates by reducing the interview biases.

The secondary research method was a systematic review that aimed at studies that covered the impact of the Office of legal affairs on the operations of the criminal justice agency. The systematic review can be considered a research process and method for identifying and appraising significant research (Pandey and Pandey, 2021). The data was gathered from articles and journals on the Office of legal affairs and general counsel. The information was useful in comprehending the general operations of the Office of legal affairs and how it influences the criminal justice agencies.

The methodology that was used in the study was selected to gather data and deduce conclusions regarding the influence of the official legal Office in the criminal justice agency operations. A major component of the Office of legal affair’s mission is to uphold justice for Texans through examining and prosecuting criminal activities such as human trafficking and helping the local law enforcement in appeals and prosecution. The study’s main aim is to understand more about the criminal justice agency operations and the effectiveness of strategies utilized in conducting their operations.

Findings

Over the years, the impact of the Office of legal affairs on criminal justice agencies’ operations has dramatically evolved. The independence of the Office of legal affairs has been eroded by the fact that law societies and courts have taken a more significant role in scrutinizing criminal offences. They have played a great role in supervising prosecutorial functions and the publication of prosecutorial guidelines (TDCJ). The Office of legal affairs is headed by the chief legal officer, who is the General Counsel. The officer offers a number of legal services to the criminal justice agency, which influences the operations of the criminal justice agency.

The Texas Department of criminal justice supervises and helps in the rehabilitation of offenders who are sentenced by local courts to community supervision. The community supervision officers examine the offender’s needs and risks through the use of standard assessment tools and utilize the results to develop an appropriate supervision plan with terms stipulated by the courts.

The Texas Department of Justice (TDJ) also provides community service restitution, urinalysis, day reporting centres, court residential treatment centres, education programs, domestic violence programs, substance abuse treatment and restitution centres. Therefore, the general role of the Texas Department of Criminal Justice is to manage the overall operations of the state’s jail system, parole and prison system. It also offers funding, oversight and training in the parole system.

The Office of legal affairs helps the Texas department of criminal justice in managing risks by offering competent legal services. It offers counsel and advice to the TDJ regarding the rights of the victims, contracts, employment law, offender healthcare, and parole and community supervision matters. The Office of legal affairs as a section drafts informal and formal legal opinions for the TDJC as demanded.

Preparing Case Hearings and Trials

The Office of legal affairs supervises the preparation of all cases that are prepared or referred for reference to the department of criminal justice for prosecution under different statutes. The attorney in the Office reviews all the indictment drafts, interlocutory trial briefs, and law memoranda.
