  • Introduction
The U.S. Equal Employment Opportunity Commission (EEOC) is a commission that is mandated with enforcing federal laws that make it illegal to in any way discriminate job applicants or employees (EEOC Website, 2020). EEOC ensures that any company that discriminates or oppresses a person based on their diversity faces the law and is punished. The Commission files charges, undertake an investigation, and lawsuits against any companies in the country found discriminating against race, sex, sexuality, religion, origin or disability, or causing oppression to the citizens.  Companies, therefore, have to oblige to the enacted laws which protect employees against any form of discrimination. The employees are protected in the events of firing, hiring, promotions, harassments, wages, benefits, and even training.  A recent case which the commission dealt with was, against Rogers Memorial Hospital which was accused of discriminating against one of its workers due to her disability which was a clear violation of the “Americans with Disabilities Act”.

Rogers Memorial Hospital was accused of disability discrimination at its Oconomowoc location.  The employee had been diagnosed with a medical condition, which affected her wellbeing.  Her treatment required her to take a short leave after the diagnosis for the sake of recuperation.  She also required an extended medical leave of absence, where she would recuperate from her continued breast cancer treatment.  Rogers provides its employees with leave under the Family and Medical Leave Act (FMLA) and also provides workers with a two-week extension if need be. However, for this particular case, the institution failed to engage the required interactive process, where it failed to provide the employee with the much need accommodation during this time.

 

  • Summarize the functions of the EEOC in one paragraph.
The U.S. Equal Employment Opportunity Commission (EEOC) is mandated with the role of investigating charges fairly and assessing the allegations when it then comes up with the solution. Its key aim is to protect the rights of individuals and interest of the public and also litigates a small percentage of the cases (EEOC Website, 2020). The agency covers most labor unions and employment agencies are also covered.   It makes sure that firms within the United States treat the workers in the right way, without any form of discrimination n. It also ensures that the Human resources processes such as hiring, firing, training, promotions, among other processes are followed according to the law, without any form of injustice, inequality, or discernment.

 

 

 

  • Explain the EEOC’s role in this lawsuit.
 The role of the EEOC was first to undertake investigations in the matter without being partisan. This is an order to comprehensively understand what took place, and which party failed to undertake their required mandate. This would be followed by arbitrating between the two parties or alternatively file a suitcase in the event there was a disagreement. In this event, the commission reached a voluntary conciliation agreement on the case.

 

  • Consider whether or not this lawsuit promotes social change. Provide examples to justify your reasoning.
The lawsuit clearly promotes social change. First, the commission noted the failure by the institution to follow the set guidelines concerning equal treatment of its employee. Punishing the institution serves as an example to other companies and organizations to respect the employees with dignity and ensure that they do not tolerate any form of discrimination, stereotyping, or stigmatization of the employees., as a way of maintaining a healthy culture.
  • Compare the EEOC press release to the news item. Are there any differences in the information that is included?
 The press release of EEOC and the new source (Frank, 2020), are almost similar. The news sources acquire most of its information from the company’s source, where there are almost equivalent information and analysis of the case, with most sources quoting the website. The only difference is the fact that the news source quotes the website, whereas the EEOC site has all the information from the actual case.  However, in general, it is apparent that the two sources are quite similar and share almost parallel information regarding the case.

 

 

 

 

 

 

 

  • Research the company’s website to ascertain if there is a mission or value statement on diversity and inclusion. If so, comment on how the incident prompting the lawsuit aligns with the company’s stance on diversity and inclusion.
Despite lacking the value statement on its website, it is apparent that Rogers’s health institution seeks to ensure diversity in its workplace, without any form of discrimination to the workers  (Rogers Behavioral Health, 2020). However, the instance of the worker who was discriminated against is proof that the institution has not fully addressed the issue of diversity and ought to have more measures.
  • Describe strategies you would implement if you were a senior manager of this company to ensure future compliance and inclusion in the multicultural workplace.
 In this case scenario, there is a need for the hospital to have a multicultural program, that will ensure that no one is discriminated against or profiled based on his disability, race, or sexuality  amongst many other factors. There is a need for inclusiveness and diversity programs that will make the employees have greater participation and enthusiasm as they work for the organization (Tatli, Ozturk, & Aldossari, 2017).  These programs and events that can be used to emphasize on quality and non-stigmatization for all the employees in the company. They will also help in stressing that all employees are involved in the programs, where they will have an interest in being part of the diversity planning of the organization (Kaplan & Mason, 2016).  Another strategy will be to have a well laid out workforce census, which will help in gaining perspective of the cultural and diversity representation at the workplace.  The census will help in sorting out races, ethnicities, ages, wellbeing, disability, and any other diversity at the workplace as a way of documenting them and ensuring that each person is treated with dignity.  The information about the workers will also help in future programming, and ensuring that equality is observed, without any future events of discrimination.

 

 

  • Conclusion
The U.S. Equal Employment Opportunity Commission (EEOC) plays a huge role in ensuring quality for all workers in the country. It also ensures that companies oblige to the mandate of ensuring that they are not discriminatory to any employee based on the disability, health status, ethnicity, race, among many other differences. The commission was involved in solving the allegation of discrimination against Rogers Memorial Hospital which was accused of discriminating against one of its employees due to her disability. This was clearly in violation of the Americans with Disabilities Act.  From such an action, the commission has proven to work towards ensuring that there is an enabling environment for all workers in the country despite their backgrounds or health status. From this case, it is apparent that Roger’s memorial needs to improve on its strategies in handling the welfare of the workers as a way of ensuring that there is no form of discrimination to any of its staff members.
