Case Analysis: Federal Aviation Act of 1958
The Federal Aviation Act was the first statute that gave the FAA the mandate to delegate the activities of private individuals who are employed by aircraft manufacturers. the designers are paid by the manufacturers but they work with the FAA in examining the aircraft design quality and their airworthiness. The FAA act of 1958 led to the birth of a federal aviation agency which was later named the federal aviation administration (Gelder,1959). The act empowered the agency to regulate the safety of the airline industry and to ensure that the military and civilians’ use of airspace in the US was safe. Their authority in regulating air travel is based on congress’s power under article 1 section 8 of the constitution where the congress was empowered to regulate the airline industry.
The federal aviation act of 1958 was created to ensure the US national air space was safe. The agency was created to ensure there was regulation of the aircraft and to ensure that the air crafts were airworthy. However, despite the agency being appointed to take control of the national airspace, it started working in stages. The agency did not have dedicated office spaces and thus the employees in the agency were housed in several buildings around Washington DC. The agency moved to administration as President Johnson was concerned about the lack of a coordinated transport system (De Florio, 2016). He believed that comprehensive transportation policies needed to be carried out by a single department. The federal aviation act was formed in the first place because the government intended to prevent the many air collisions that were happening in the country, the fact that the agency was not working well was enough reason for the citizens to be worried about the safety of air transport.
III. Significance of the Problem
Air travel was one of the greatest discoveries of the century. It made it possible for people to travel internationally. It was also one of the greatest military discoveries. However, the citizens needed to feel safe. Air travel needed to be regulated to prevent the high number of lives lost due to the lack of regulation (Lawrence, 2004). The delays in the agency taking over the safety of air travel posed a significant threat to anybody with the intention of traveling. The fear of death on air was valid at the time and there was a need for a solution to stop risking civilian lives.
Alternative Action 1. The government should have developed an air control unit earlier to create policies that increased the safety of the airspace and ensured that the civilians were safe.
Advantages. This could have prevented the loss of lives as a result of aircraft accidents and collisions. American
Alternative Action 2. Before creating an agency, they should have figured out the roles of the agency and provided the resources they needed to ensure that the American airspace was safe.
Advantages. This action would have prevented the confusion that faced the employees. They did not have a suitable work environment which made their work harder. They were also distributed across Washington which made the agency uncoordinated.
The need for an agency regulating air travel was clear in the country. There needed to be some regulation around the aviation industry and the type of aircraft that left the ground. There was also the need to direct the pilots to prevent them from colliding with each other. This could have been done sooner and in a more organized manner. Planes should have been grounded until the country developed a safer way of air travel or a self-sufficient agency in air travel.
