Breach of Contract Case Study

Scenario

On 5th February 2021, a party was held at my residence, in Florida USA. Prior to the party, several companies including L&C, Jumbo, and Blue Rock were hired to provide supplies for the party. Firstly, a contract was made with L&C, to supply various items including a cake, beverages, and cooks to prepare food at the party. On the other hand, I entered into an agreement with Jumbo, an entertainment company to play music during the party. Blue Rock entered into a contract to provide security during the party. The companies promised to commit to the agreement at the day of the party.

Breaches

On the day of the party, L&C brought less cooks than expected, leading to delays in the preparation of meals. As a result, I was forced to contract two additional cooks to assist in kitchen activities. L&C failed to meet the standards of services that were indicated during the contract. The company had promised to prepare quality meals and also deliver adequate drinks to serve thirty five people. However, the beverages brought by the vendor were inadequate for the attendants.

While Jumbo met its contractual obligations, Blue Rock wrote an email on the day of the party, stating that they were unable to commit to the agreement. During the party, a fight broke, leading to the injury of one person. I was forced to pay $20,000 in compensation for the injuries, as I failed to provide security during the party. The scenario broke my relationship with two business associates.

Remedies and Damages

L&C is liable for direct damages because it failed to provide adequate staff, forcing me to hire additional workers. On the other hand, Blue Rock is liable for direct damages, as it failed to provide security during the party. L&C is liable for consequential damages. As a result of L&C actions, I incurred $20,000 to pay for the services provided by additional workers. Additionally, the party was delayed because L&C lacked the capacity to execute its contract.  L&C is liable for reliance damages of about $5,000. The damages include the cost of hiring new workers and the damage of reputation.

Blue Rock is liable for reliance damages due to its failure to ensure security during the party. As a result, the quantifiable amount for the damage will be approximately $30,000. The amount includes the payments made to the injure individuals during the party. L&C is liable for restitution damages because it failed to meet its obligations (JEC, 2021). L&C is liable for specific performance damages due to its inability to deliver the specified quality of supplies and services.
